These Terms and Conditions govern all vehicle rental agreements between Malak Prestige Car SARLAU (hereinafter "the Company", "we", "us") and the customer (hereinafter "the Renter", "you"). By making a booking through our website, through Booking.com, RentalCars.com, or any affiliated platform, you confirm that you have read, understood, and agree to be bound by these terms.

Malak Prestige Car is a licensed car rental operator based in Casablanca, Morocco.

We operate in full compliance with Moroccan transportation law and international standards.

To rent a vehicle, all drivers must meet the following mandatory criteria:

• Minimum age: 23 years for standard premium vehicles; 25 years for high-end sports cars and SUVs (e.g., Porsche, Ferrari, Lamborghini).
• Valid driving license: Held for a minimum of 2 years. An International Driving Permit (IDP) is required for licenses not written in French, Arabic, or English.
• Valid identity document: National ID card (CIN) for Moroccan residents; valid passport for international clients.
• Payment method: A valid credit or debit card in the primary driver's name is required at pickup for the security deposit pre-authorization.
• All additional drivers must meet the same eligibility requirements and must be present at the time of vehicle pickup with their valid documentation.

A booking is considered confirmed only after receiving a written confirmation email or confirmation number from Malak Prestige Car or the booking platform.

• Booking deposit: A deposit may be required at the time of booking to secure the reservation, as specified on the booking platform.
• Remaining balance: The remaining rental cost is due at vehicle pickup unless fully prepaid at booking.
• Pricing: All displayed prices include standard insurance (CDW) and are quoted in Moroccan Dirham (MAD) unless stated otherwise. Taxes (20% VAT) are included.
• Accepted payment methods: Visa, Mastercard, and bank transfers. Cash payments are accepted at our agency upon agreement.
• Prices displayed on third-party platforms (Booking.com, RentalCars.com) are binding as confirmed at the time of booking.

Our cancellation policy is designed to be fair and transparent in compliance with Booking.com and RentalCars.com partner standards:

• Free cancellation: Full refund for cancellations made more than 48 hours before the scheduled pickup time.
• Late cancellation: Cancellations made within 48 hours of pickup will incur a charge equal to 1 (one) day's rental fee.
• No-show: If the renter fails to collect the vehicle without prior cancellation notice, the full booking amount may be charged.
• Modifications: Any changes to the booking (dates, vehicle, pickup location) are subject to availability and may affect the price. Modifications must be requested at least 24 hours in advance.
• Vehicle unavailability: If the booked vehicle is unavailable due to unforeseen circumstances, we guarantee a vehicle of the same category or higher at no extra cost, or a full refund will be issued.

A refundable security deposit (caution) is required at vehicle pickup. This amount is pre-authorized (blocked) on your credit card — it is not debited unless damage, fines, or violations are recorded.

• Standard vehicles: Deposit between 5,000 MAD and 15,000 MAD.
• Premium/Sport vehicles: Deposit between 15,000 MAD and 50,000 MAD.
• The deposit hold is released within 7–14 business days after vehicle return, subject to inspection and verification of traffic fines.
• Any damage not covered by the insurance, or any outstanding fines/tolls accrued during the rental, will be deducted from the deposit.
• A debit card or cash caution may be accepted at our discretion for certain vehicle categories only.

All Malak Prestige Car vehicles include the following standard insurance coverage:

• Third-Party Liability (RC): Mandatory civil liability insurance as required by Moroccan law, covering damage to third parties.
• Collision Damage Waiver (CDW): Reduces the renter's financial liability in case of an accident, subject to the applicable franchise (excess) amount.
• Theft Protection (TP): Coverage against vehicle theft, subject to franchise and conditions (e.g., no negligence, vehicle locked).

The following are NOT covered by standard insurance:

• Damage to tyres, windscreen, underbody, or interior caused by misuse.
• Damage resulting from driving under the influence of alcohol or drugs.
• Damage caused by driving outside Morocco without prior written authorization.
• Traffic violations, speeding fines, and parking tickets.

Optional full coverage (Super CDW / Zero Excess) may be purchased at the time of booking or at pickup, eliminating the renter's financial liability for accidental damage.

• Vehicles must remain within the borders of Morocco unless written authorization for cross-border travel has been obtained in advance.
• Smoking is strictly prohibited in all vehicles. A mandatory deep-cleaning fee of 2,500 MAD will apply if smoking evidence is found.
• Off-road driving is strictly prohibited except for designated 4x4 vehicles on maintained tracks.
• The vehicle must not be used for subletting, commercial transportation of passengers, racing, or towing.
• Animals are not permitted in the vehicle without prior written approval.
• The renter is responsible for ensuring the vehicle is locked and secured when unattended.

Our standard fuel policy is Full-to-Full:

• Vehicles are provided with a full tank of fuel and must be returned with a full tank.
• If the vehicle is returned with less fuel, a refueling charge of the market price per litre + a service fee of 150 MAD will apply.
• Prepaid fuel options may be available at the time of booking.

The renter assumes full responsibility for any traffic violations, speeding tickets, parking fines, or toll charges incurred during the rental period.

• Malak Prestige Car will forward any fines received after the rental to the renter along with a 30 MAD administration fee per fine.
• The renter's credit card on file may be charged for outstanding fines up to 60 days after the rental end date.

Malak Prestige Car shall not be held liable for:

• Loss of, or damage to, personal belongings left in the vehicle.
• Any indirect, incidental, or consequential damages arising from the use of our vehicles.
• Delays or failures resulting from force majeure events (strikes, natural disasters, government actions, etc.).

Our maximum liability to the renter under any circumstances shall not exceed the total rental amount paid for the specific rental agreement.

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco.

Any dispute arising from or in connection with a rental agreement that cannot be resolved amicably shall be submitted to the competent courts of Casablanca, Morocco.

For complaints or disputes arising from bookings made through Booking.com or RentalCars.com, you may also utilize the dispute resolution mechanisms provided by those platforms.
